Virginia Beach is Virginia’s most populous independent city at roughly 460,000 residents — a city that spans from the bustling Atlantic Ocean resort strip at the Oceanfront, through Naval Air Station Oceana’s sprawling military footprint in the central city, to the rural and agricultural Southern Shore along the North Carolina border. The city is simultaneously a world-famous beach destination, a major military hub, and a growing tech and healthcare economy anchored by Sentara and Optima Health. The rental market is among the most complex in Virginia: Oceanfront and near-beach properties command seasonal and year-round premium rents, while Princess Anne, Kempsville, Dam Neck, and the western borough neighborhoods offer more affordable inventory with consistent military family and healthcare worker demand.

Virginia requires 5-day written pay-or-quit notice (§55.1-1245(F)). No statutory grace period, but rent must be 5 days late before late fees apply (§55.1-1204.1). Tenant can redeem tenancy by paying all rent, late fees, attorney fees, and court costs on or before the court return date (§55.1-1250). Tenant may also present a "redemption tender" - a written commitment from a government or nonprofit entity to pay within 10 days of return date. Late fee cap: 10% of periodic rent. The Eviction Diversion Program was renewed and expanded in 2025, allowing qualifying lower-income tenants to be placed on court-ordered payment plans.
Serve the required notice based on the eviction reason (nonpayment or lease violation).
Wait for the notice period to expire. If tenant cures the issue (where allowed), the process stops.
File an eviction case with the General District Court. Pay the filing fee (~$58).
Tenant is served with a summons and has the opportunity to respond.
Attend the court hearing and present your case.
If you prevail, obtain a writ of possession from the court.
Law enforcement executes the writ and removes the tenant if necessary.

Virginia Beach City Virginia Landlord-Tenant Law: Virginia’s Most Populous City — NAS Oceana, the Oceanfront, and UD Tuesdays in Courtroom H
Virginia Beach operates at a scale that sets it apart from every other independent city in the Commonwealth. At 460,000 residents spread across 497 square miles — including ocean beach, bay shore, military base, suburban neighborhoods, and farmland — it is a genuine metropolis that happens to carry the legal designation of an independent city. Naval Air Station Oceana dominates the central city’s geography and employment, generating a massive and consistent pipeline of active-duty Navy pilots, officers, sailors, and their families whose housing needs keep rental demand strong across the city’s residential neighborhoods year-round. Include a military clause in every lease in Virginia Beach — it is not optional in this market. The resort district along the Oceanfront drives vacation rental demand and creates a category of property that requires different management strategies than standard annual-lease rentals. The Virginia Beach GDC at 2425 Nimmo Parkway handles civil matters through two courtrooms: Courtroom G handles high volume attorney case first returns (Mon–Fri 8:30 and 9:30 a.m.), while Courtroom H is the UD landlord’s primary venue — unlawful detainers are heard specifically on Tuesdays at 8:30 a.m. in Courtroom H. First returns on warrants, garnishments, and notices run Mon/Wed/Thu/Fri (except 2nd Friday) at 8:30 a.m. Contested matters are set for future dates at 9:30 a.m. Small claims are heard the 2nd Friday at 8:30 a.m. Continuances follow Supreme Court Rule 7A:14 strictly — written motions by mail or hand delivery before trial, or fax if mail won’t arrive in time. Day-of requests must be in person or faxed in genuine emergencies. Email motions are explicitly and absolutely not accepted. Legal Aid Society of Eastern Virginia: (757) 627-5423.
