Sebastian County Rental Market Overview

Sebastian County is the fourth most populous county in Arkansas, anchored by Fort Smith — the state’s second-largest city — at the confluence of the Arkansas and Poteau rivers on the Oklahoma state line. With a population of 127,799 (2020 census), it is the heart of the Fort Smith Metropolitan Statistical Area, a bi-state region of approximately 298,592 residents covering Sebastian, Crawford, and Franklin counties in Arkansas, and Le Flore and Sequoyah counties in Oklahoma. The county is named for William K. Sebastian, a U.S. Senator from Arkansas, and was formed on January 6, 1851.

The economy is one of the most diversified in Arkansas: manufacturing (Whirlpool appliances, Baldor Electric, furniture, HVAC equipment, processed poultry), healthcare (Mercy Hospital, Baptist Health, UAFS medical programs), retail, distribution, and technology. Fort Chaffee — a former Army training base now being redeveloped as Chaffee Crossing — is a major economic driver. All evictions are filed in the 12th Judicial Circuit Court. Sebastian County is a wet county.

⚖️ Judge Isaac Parker — The Hanging Judge — Served 1875–1896; sentenced 160 to death; 79 executions carried out; Fort Smith NHS = more executions by U.S. government than anywhere else in American history; his restored courtroom and “Hell on the Border” jail are open to visitors   |
🤠 Bass Reeves — First Black deputy U.S. marshal west of the Mississippi; served under Judge Parker; widely considered a possible inspiration for the Lone Ranger character   |
🏕️ Fort Chaffee Legacy — WWII training + 3,000 German POWs; 50,000+ Vietnam refugees (1975); Cuban refugees + riot (1980); 10,000 Hurricane Katrina evacuees (2005); now Chaffee Crossing redevelopment district   |
🛤️ Trail of Tears Western Terminus — Second fort (1836) served as the western end of Indian removal; Fort Smith also the gateway city for westward expansion during Manifest Destiny

Sebastian County Ordinances & Local Rules

Topic Rule / Notes
⚠️ Which Court to File In Sebastian County has operated under a dual-district system since 1874. All evictions must be filed in the correct judicial district based on where the rental property is located. Fort Smith Northern District: covers Fort Smith city limits and Upper Township — file at 901 South B St., Room 205, Fort Smith AR 72902, (479) 782-1046. Greenwood Southern District: covers Greenwood and the remainder of Sebastian County — call (479) 996-4175 for the Greenwood office. Circuit Clerk Susie Hassett serves both offices. If you are unsure of the district for your property, call the clerk’s office before filing.
Rent Control None. Arkansas preempts local rent control statewide. No city or county in Arkansas may impose rent control. Landlords in Fort Smith, Greenwood, Barling, Van Buren (Crawford Co.), or anywhere in Sebastian County may raise rents freely at renewal or with 30 days’ written notice on month-to-month tenancies.
Security Deposit Capped at 2 months’ rent (A.C.A. § 18-16-304). Applies to landlords renting six or more dwellings. Return with written itemized deductions within 60 days of termination (A.C.A. § 18-16-305).
Notice to Vacate — Nonpayment Written 3-day notice to vacate required before filing for unlawful detainer for nonpayment. Best practice: wait until rent is at least 5 days past due before serving (A.C.A. § 18-17-901). Retain dated proof of service.
Lease Violation Notice For non-rent violations, serve a written 14-day notice to cure or quit identifying the specific breach (A.C.A. § 18-17-701). If the tenant remedies the violation within 14 days, the tenancy continues.
Month-to-Month Termination 30-day written notice required to terminate a month-to-month tenancy (A.C.A. § 18-17-704). Week-to-week tenancies require 7-day written notice.
Oklahoma Border Market — Cross-State Workers Fort Smith sits directly on the Oklahoma state line, and a significant number of residents work in Oklahoma (Sequoyah County, Muskogee area) or commute in from Oklahoma to Fort Smith employers. Oklahoma W-2 wages and pay stubs are valid income verification. Verify the stability of Oklahoma-based employment the same way you would Arkansas employment — current pay stubs (2–3 months), VOE letter, and prior year W-2 or tax return.
Manufacturing Workers Sebastian County’s manufacturing base — Whirlpool, Baldor Electric, ArcBest (formerly ABF Freight), OK Foods, furniture producers, and dozens of smaller plants — employs a large share of the rental market. Hourly manufacturing and warehouse workers: verify with 2–3 months of pay stubs and confirm full-time status. Union employees have contractual wage protections; verify union membership and seniority where applicable. For workers at Fort Chaffee’s Chaffee Crossing redevelopment, confirm current employment status and tenure.
Healthcare & UAFS Workers Mercy Hospital Fort Smith, Baptist Health, and the University of Arkansas–Fort Smith are major healthcare and educational employers with stable year-round payroll. W-2 annual employees: straightforward verification. Traveling nurses: verify contract terms, agency, and contract length — verify renewal before lease commencement or use shorter lease terms with renewal options.
No Warranty of Habitability (Default) Arkansas does not impose a general implied warranty of habitability by default. Leases executed after October 2021 carry some statutory habitability protections unless waived in writing. Tenants have no repair-and-deduct remedy under Arkansas law.
Abandoned Property Personal property remaining after lease termination is deemed abandoned and may be disposed of by the landlord (A.C.A. § 18-16-108). Document with timestamped photos and video before disposal.
Self-Help Eviction Prohibited. Do not attempt lockouts, utility shutoffs, or removal of belongings without a court order. Always use the lawful judicial process through the 12th Judicial Circuit Court in the appropriate district.
Late Fees & NSF Checks No statutory cap on late fees in Arkansas. Specify amount and grace period in writing in the lease. For returned checks: $30 per check plus bank fees (A.C.A. § 5-37-307(c)(2)(B)).

Sebastian County Arkansas Landlord-Tenant Law: Judge Parker, Bass Reeves, Fort Chaffee, Two County Seats, and What Every Landlord Needs to Know

Sebastian County occupies the far western edge of Arkansas at the confluence of the Arkansas and Poteau rivers — a location that has made it a crossroads of American history for more than two centuries. The county was named for William K. Sebastian, a U.S. Senator from Arkansas, and created on January 6, 1851, from parts of Crawford, Polk, and Scott counties. From its beginning, the question of where to locate county government produced such fierce conflict that the state legislature ultimately gave Sebastian County something almost no other county in America has: two permanent county seats. Fort Smith has served as the northern district seat and Greenwood as the southern district seat since 1874 — and that arrangement continues to this day.

The Dual-District System: Why It Matters for Landlords

The dual-district arrangement is not merely historical trivia — it has direct and practical consequences for landlords filing evictions. Sebastian County evictions must be filed in the judicial district corresponding to where the rental property is physically located. Properties within Fort Smith and the Northern/Upper Township area are filed in the Fort Smith District; properties in Greenwood and the remainder of the county are filed in the Greenwood District. Both districts are served by the same Circuit Clerk, Susie Hassett, at 901 South B Street, Room 205, Fort Smith, (479) 782-1046, with a separate Greenwood office at (479) 996-4175. Filing in the wrong district will result in delay and potentially dismissal. If you are uncertain about your property’s district, call the clerk before filing.

Judge Isaac Parker: The Hanging Judge

No figure in Fort Smith’s history looms larger than Judge Isaac C. Parker, appointed to the federal bench by President Ulysses S. Grant in 1875. Parker presided over the United States District Court for the Western District of Arkansas, which had jurisdiction not only over western Arkansas but over all of Indian Territory to the west — an enormous, often lawless region beyond the reach of local law. Over a career spanning 21 years until his death in 1896, Parker sentenced 160 people to hang; 79 executions were carried out. The Fort Smith National Historic Site — including Parker’s restored courtroom and the grim frontier jail known as “Hell on the Border” — is recognized as the location where more people were put to death by the U.S. government than at any other single place in American history. Parker worked closely with Bass Reeves, the first Black deputy U.S. marshal appointed west of the Mississippi River, whose career has made him one of the most celebrated lawmen of the frontier era and a figure some historians believe inspired the fictional Lone Ranger.

Fort Chaffee: From WWII to Hurricane Katrina

Camp Chaffee — later Fort Chaffee — was established just outside Barling in 1941 as an Army training center. During World War II it trained the Sixth, Fourteenth, and Sixteenth Armored Divisions and held approximately 3,000 German prisoners of war. In the mid-1970s, it processed more than 50,000 Vietnamese refugees following the fall of Saigon, many of whom settled permanently in Fort Smith and created the Vietnamese and Laotian Buddhist communities visible in the city today. In June 1980, a riot by some 2,000–3,000 Cuban refugees at the fort drew national media attention. In 2005, Fort Chaffee housed more than 10,000 evacuees from Louisiana, Texas, and Mississippi displaced by Hurricane Katrina. In 1997, the Army transferred the fort to the Arkansas National Guard, and portions were turned over for commercial and industrial redevelopment as the Chaffee Crossing district, which continues to generate economic activity in the county.

Arkansas Landlord-Tenant Law in Sebastian County

All residential rental relationships in Sebastian County are governed by statewide Arkansas law. There is no local rent control — state law preempts any county or municipal rent control ordinance. For nonpayment, serve a 3-day written notice to vacate after rent is at least 5 days past due, then file an Unlawful Detainer complaint with Circuit Clerk Susie Hassett in the appropriate district: Fort Smith (479) 782-1046 or Greenwood (479) 996-4175. For lease violations, serve a 14-day notice to cure. Month-to-month tenancies require 30 days’ written notice to terminate. Security deposits are capped at two months’ rent for landlords with six or more units, returned with written itemized deductions within 60 days. No implied warranty of habitability by default; no repair-and-deduct remedy; self-help evictions are prohibited. Sebastian County is a wet county.
