In Florida, before filing for eviction due to non-payment of rent, you must first serve the tenant a written 3-Day Notice to Pay or Vacate. The three days exclude Saturdays, Sundays, and court-observed legal holidays — a notice served on Thursday gives the tenant until the following Tuesday. The notice must state the exact dollar amount owed, the property address including county, and demand either payment in full or possession within those three days. Accepting any partial payment after serving the notice may waive your right to proceed with the eviction.
